Terms of sale

1. Scope of Application

These general terms and conditions of sale (hereinafter “the General Conditions”) govern the relationship between ROGER ET CIE, a simplified joint stock company with capital of €1,500,000, registered with the Nanterre Trade and Companies Register under VAT number 432 099 836, whose head office is located at 32-36 rue des Coudrais, 92330 Sceaux, France (hereinafter “Patrick Roger Chocolaterie”), and any consumer in the legal or jurisprudential sense who wishes to make a purchase exclusively for their own account via the company’s online sales website (hereinafter “the Client”) accessible at www.patrickroger.com (hereinafter “the Site”).

2. Acceptance and Binding Nature

By validating their order on the Site via the “place order” button, the Client unreservedly accepts these General Conditions, which apply until the expiry of any legal guarantees to which they are entitled.
Patrick Roger Chocolaterie reserves the right to modify the General Conditions at any time. The General Conditions applicable are those in force on the Site on the day the order is validated.
No other provision, clause, or condition originating from the Client may override these General Conditions.

3. Products

The Site offers for sale Products (hereinafter “Products”) with a description stating their main characteristics (name, quality, composition, content). Images are as accurate as possible but are not contractually binding.
The offer is subject to seasonality and limited stock availability.
Products offered on the Site cannot have their composition or presentation modified.
In case of weather conditions incompatible with normal preservation of the Products, Patrick Roger Chocolaterie reserves the right to suspend online offers of one or more Products, which will then be refunded via credit to the card used for payment.

4. Prices and Delivery Costs

Product prices are displayed on the Site in euros, inclusive of packaging and handling, all taxes included, but excluding delivery and possible customs fees, which are borne by the Client.
Value added tax (VAT) at 5.5% or 20% applies depending on the Products for orders destined for Metropolitan France, Overseas France, Corsica, and EU countries.
Due to specific preparation, packaging, and handling costs for online sales, the Site price may differ from in-store price.
Patrick Roger Chocolaterie reserves the right to change prices at any time. However, the price shown on the Site at the time the order is confirmed by Patrick Roger Chocolaterie is the applicable price to the Client.
Delivery charges depend on order specifics (weight, geographic zone, mode of delivery) and are communicated to the Client during the ordering process, before final validation. Unless delivery is offered free, the Client must pay these costs before dispatch.
The Client is responsible for informing themselves of customs duties, taxes, and local import regulations in the destination country. Any customs duties, taxes or import charges are the Client’s responsibility, as are associated formalities.
In case of payment incident after delivery, Patrick Roger Chocolaterie has the right to claim the Products; transfer of ownership is only effected once full payment is received.

5. Ordering

Order by Client via the Site

The Client places an order on the Site to purchase one or more Products. Products are entered into the cart with quantity and total price (tax included).
The Client identifies themself on the Site and provides all information needed for billing and delivery (name, full address, floor, door code, telephone, etc.). Orders indicating a PO box address will not be accepted.
The cart, including delivery fees, is reviewed and validated by the Client through the “place order” button.
The Client pays online by credit card: Carte Bleue, Visa, Mastercard. The SSL security protocol ensures confidentiality of personal data transmitted over the Internet. American Express cards are not accepted.
The currency for the transaction is the euro. The amount debited will depend on the euro exchange rate on the day of debit, as well as any foreign exchange fees charged by the issuing bank.
An order is only accepted once full payment is successfully received by Patrick Roger Chocolaterie.

Product Availability

Once payment is confirmed, the Client receives an email confirming acceptance of the order by Patrick Roger Chocolaterie, or indicating unavailability of one or more ordered Products.
If unavailable, the Client is informed as soon as possible by email and refunded within 30 working days via credit to the payment card.
Products are made artisanally and in limited quantities. They may be temporarily unavailable, especially during high-demand periods (e.g. end-of-year holidays, Easter).

Order Preparation

Once availability is confirmed, Patrick Roger Chocolaterie prepares and dispatches the order per the agreed delivery mode.
Packages are prepared in secure, sturdy packaging to minimize damage during transport.
A second email is sent to the Client confirming shipment, providing tracking number and carrier link. If delivery is by courier, the Client receives an SMS.
A detailed invoice is appended to the email.
Any confirmed order is final and cannot be canceled, except in cases of product unavailability, the Client’s right of withdrawal, or force majeure.
Data recorded in Patrick Roger Chocolaterie’s information system constitute proof of all transactions.

6. Delivery

Delivery Information

Patrick Roger Chocolaterie delivers in all geographic areas except the United States and Russia, barring special conditions affecting Product delivery (e.g. weather).
If the Client’s delivery information is incomplete or incorrect, Patrick Roger Chocolaterie may contact the recipient by phone to complete missing information, provided a correct reachable number is given.

Delivery Methods

Deliveries are made on working days (excluding Saturdays, Sundays, and public holidays) to the address indicated by the Client via Chronopost, GLS, DHL, or courier.
Courier delivery is only possible (i) for orders placed Monday to Friday before 13:00, (ii) for delivery during Patrick Roger Chocolaterie’s business hours, and (iii) only within Paris intramuros and certain neighboring municipalities (list provided).
Fragile or bulky Products are necessarily delivered by couriers in vehicles; their cost is communicated before order validation.

In high activity periods (e.g. holidays, Easter, Valentine’s), dispatch delays may extend: up to 5 working days for transporter deliveries, 1 working day for couriers. Order deadlines may be imposed for special event deliveries.

Delivery Delays

Outside peak periods, if shipment delay attributable to Patrick Roger Chocolaterie exceeds 24 hours, the Client may cancel without charge by email to boutique@patrickroger.com and a call to +33 1 40 54 06 00 or +33 6 43 77 04 84, indicating their intent to cancel and be refunded.
Delays caused by the carrier or courier cannot be attributed to Patrick Roger Chocolaterie and do not warrant refunds. However, the company commits to filing a claim with the carrier upon presentation of proof by the Client.
In case of recipient absence, a delivery notice is left. The parcel must be collected within 4 calendar days, given product fragility. Failure to collect will be deemed delivery complete, with no refund or reshipment possible.
For courier deliveries, the Client must remain reachable by phone on delivery day. If unreachable, the order is returned to the boutique address and held for 2 working days for pickup. Unclaimed parcels after this period are considered delivered and non-refundable.
Patrick Roger Chocolaterie is not liable for product deterioration caused by delayed collection from carrier or boutique.

Deliveries outside the European Union

Orders shipped outside the European Union may be subject to controls, formalities and decisions by the customs authorities of the destination country, which are beyond the Company's control.

Any customs duties, local taxes, import charges and declaration obligations are the sole responsibility of the recipient. The competent authorities may contact the recipient directly for this purpose.

Customs clearance procedures may cause delivery delays. The Company does not guarantee any firm delivery times for deliveries outside the European Union.

The Customer acknowledges that these delays may affect the minimum shelf life or recommended consumption date of the products. The Company cannot be held liable for the consequences of customs decisions or procedures.

Customs checks may involve the opening and handling of packages. The Company declines all responsibility in the event of any alteration to the packaging, appearance or quality of the products resulting from these checks.

The products are labelled in accordance with current European regulations. No specific adaptation to the regulations of the country of destination is guaranteed.

7. Guarantees & Claims

Visible defects and commercial guarantee

The recipient must check parcel condition and conformity immediately upon receipt.
Any visible anomaly (missing item, breakage, damaged packaging) must be noted on delivery receipt and notified to Patrick Roger Chocolaterie promptly: within 48 hours for carrier delivery, 24 hours for courier delivery.
If the defect is attributable to Patrick Roger Chocolaterie, the Product(s) will be exchanged at no cost.

Latent defects & statutory warranties

The Client benefits from statutory warranties of conformity (Articles L. 211-4 to L. 211-13 of the French Consumer Code) and hidden defects (Articles 1641 to 1648 & 2232 of the French Civil Code).
In exercising warranty of conformity, the Client may choose repair or replacement of the Product, subject to cost limitations in the law.
Under the warranty for hidden defects, the Client may choose contract rescission or a price reduction.

Exercising Guarantees

The Client may submit claims via email to boutique@patrickroger.com, then return the parcel by post to:
Patrick Roger Chocolaterie – 32-36 rue des Coudrais, 92330 Sceaux, with proof of purchase.
Patrick Roger Chocolaterie does not guarantee:

  1. Products whose expiry date has passed at time of claim

  2. Damages (delay, non-delivery, unfit product) due to incomplete or erroneous Client information or late parcel collection

  3. Damages caused by misuse, improper storage by Client, or causes outside the intrinsic qualities of Products
    The Client is informed that chocolates and confections must be stored between 15 °C and 20 °C in a dry place, in their original packaging. High heat or cold may degrade the product.
    Ingredients and allergen declarations (e.g. nuts, milk, soy, egg, gluten) are included. The Client must check that imported Products comply with destination country consumption rules.

8. Right of Withdrawal

Non-perishable Products

The Client has a 14-calendar-day right of withdrawal starting the day after receipt of non-perishable Products (books, cocoa powder, etc.). Notification must be via the withdrawal form or any unambiguous declaration, accompanied by proof of purchase to boutique@patrickroger.com or by post to the Sceaux address.
Products must be returned in intact, original packaging at Client’s expense within 14 days following notification. Any handling depreciating the Product may engage Client liability.
Refunds are made within 14 days of receipt of withdrawal decision, by the same payment method used. Return shipping costs are borne by Client.

Rapidly Perishable Products (chocolates, confections, etc.)

Under law, withdrawal does not apply to:

  • Products made to consumer specifications or clearly personalized

  • Products that deteriorate quickly, like chocolates or confections

  • Products whose packaging has been unsealed by the Client and cannot be returned for hygiene or health reasons

9. Alcohol Sales Information

Article L. 3342-1 of the French Public Health Code prohibits sale or offer of alcoholic beverages to minors. Clients acknowledge legal capacity and may be required to prove age.
Sales of wine to professionals or merchants cannot occur via the Site and must follow a specific ordering process.

10. Resale Prohibition

The Client undertakes not to resell Products. They are intended solely for personal use or for the designated recipient.

11. Intellectual Property

The PATRICK ROGER brand is registered. All illustrations, graphics, logos, texts on Products, packaging, the Site or social media are the exclusive intellectual property of Patrick Roger Chocolaterie. Any reproduction, exploitation or usage, even partial, is prohibited.

12. Personal Data Protection

The Client consents to personal data processing by ROGER ET CIE for purposes of order processing, delivery, after-sales service, and commercial proposals, within the bounds of legal obligations and the GDPR (EU Regulation 2016/679) and French “Informatique et Libertés” law.
Certain data are mandatory; absence may prevent order processing.
Clients have rights of access, correction, erasure, opposition, limitation and portability. To exercise them, contact boutique@patrickroger.com or write to the head office, with proof of identity.

13. Force Majeure, Third-Party Causes & Health Context

Neither Party is liable for non-performance due to force majeure (per article 1218 of the French Civil Code).
Temporary impediments suspend obligations; permanent ones terminate the contract.
If the order has not been shipped, the contract is resolved automatically and refunded.
Any COVID-19 administrative decisions are considered force majeure.

14. Independence of Clauses & Governing Law

If any provision is held invalid or inapplicable, it does not affect the remaining provisions, which will remain enforceable. The invalid clause is replaced by the closest lawful provision.
These General Conditions are governed exclusively by French law. Disputes are brought before the competent French courts.

15. Claims & Mediation

For any difficulty regarding online Product sales, the Client is encouraged to contact Patrick Roger Chocolaterie at boutique@patrickroger.com first.
If the complaint remains unresolved, the Client may resort to mediation via the FEVAD e-commerce mediator:
